What for actions do I need to take if my relationship ends?
If you were married or had a registered partnership
After your divorce or separation, you and your ex-partner are both entitled to one-half of the old age pension that has been accrued in ING CDC Pensioenfonds over the years that you were married or registered partners. This is the standard settlement that has been provided by law. If you want your ex-partner to receive partner pension directly from ING CDC Pensioenfonds as from the date you retire, you or your ex-partner must report this to us within two years after your divorce by submitting the form ‘Pensioen voor ex-partner’ (Dutch only). Contact the Pension Desk in case you need help to complete the form.
If this is not what you want, neither of you should submit this form and you will then have to pay your ex-partner his/her pension yourself.
Make sure you send a copy of your divorce settlement to ING CDC Pensioenfonds.
In your divorce settlement, you and your ex-partner could agree to divide your pension differently than the 50-50% standard. If you do, you must report this to the pension fund within two years after your divorce.
If your partner wishes to forfeit his/her right to special partner pension, he/she must report this to the pension fund. You will have to agree to this forfeiture. Both of you can use the sample statement of forfeiture available on the website. You will both have to submit such a statement. Note that additional conditions may apply to your situation and that your request will need to be approved by the pension fund.
In your divorce settlement, you could assign to your ex-partner the independent right to receive a portion of your old age pension. Additional conditions may apply in your case. Please contact the Pension Desk to find out more.
If you were cohabitating
You must report the end of your relationship to us by submitting the form ‘Ontbinding partnerschap bij samenleven’ (Dutch only). Contact the Pension Desk in case you need help to complete the form.
How can I calculate the effect the end of my relationship will have on my pension?
Once ING CDC Pensioenfonds has been informed of the end of your relationship, you will be sent a letter confirming which portions of your pension will be for you and your ex-partner respectively.
I still have pension in Pensioenfonds ING. Do I need to report anything to them, or will you do that for me?
You will only need to report to us if you end the cohabitation with your partner. You must report the information to each pension fund separately. To ING CDC Pensioenfonds by logging into your personal account in My Pension. Contact the Pension Desk in case you need help.
Your ex-partner will be entitled to special partner pension. In addition, you and your ex-partner will both be entitled to half of the old-age pension that was built up during your marriage or registered partnership.
These are the standard conditions that have been provided by law. You and your ex-partner can decide to deviate from them and agree on other terms, subject to certain conditions. It is advisable to consult with a advisor on this matter.
